By accessing and using the Asia Direct website (asiadirect.africa) and our associated logistics and sourcing services, you accept and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.
- Website Access: Simply browsing or accessing asiadirect.africa constitutes acceptance of these Terms and our Privacy Policy.
- Enquiry Submission: Submitting any enquiry, request for quotation, or contact form creates a service relationship subject to these Terms.
- Service Engagement: Engaging Asia Direct for logistics, sourcing, or any other paid service constitutes full acceptance and creates a binding contract.
Asia Direct provides an integrated range of international trade and logistics services. Our services include but are not limited to:
- Product Sourcing: Identifying, vetting, and procuring products from verified suppliers in China and across Asia
- Sea Freight: Full Container Load (FCL) and Less than Container Load (LCL) shipping from Asia to Southern Africa
- Air Freight: Expedited air cargo services for time-sensitive shipments
- Express Courier: Door-to-door delivery for smaller commercial consignments
- Customs Clearance: End-to-end customs brokerage and trade compliance support
- Quality Control: Pre-shipment inspection and factory audit services
- Supplier Vetting: Comprehensive background checks and due diligence on Asian manufacturers
Service Availability
Our services are available to clients across Southern Africa including South Africa, Botswana, Namibia, Zambia, and Zimbabwe. International enquiries are considered on a case-by-case basis. Service availability may be subject to regulatory requirements in your jurisdiction.
When using Asia Direct's services, you agree to the following obligations:
Accuracy of Information
- Provide accurate, complete, and current information when making enquiries or placing orders
- Promptly notify us of any changes to your contact details, business registration, or shipping requirements
- Ensure all product descriptions, specifications, and quantities provided to us are correct
- Supply all required customs documentation and trade certificates in a timely manner
Prohibited Activities
- Using our services to import goods prohibited by South African law or international trade sanctions
- Misrepresenting goods for customs valuation or classification purposes
- Attempting to circumvent any legal, regulatory, or compliance requirements
- Engaging in fraudulent transactions or providing false commercial invoices
- Using our website in any manner that could damage, disable, or impair the site
To the maximum extent permitted by applicable law, Asia Direct's liability is limited as follows:
- Asia Direct shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our services
- Our total liability to you for any claim shall not exceed the value of the specific transaction giving rise to the claim
- We are not responsible for delays, losses, or damages caused by third-party carriers, customs authorities, or circumstances beyond our reasonable control
- Asia Direct does not guarantee uninterrupted, error-free, or virus-free operation of our website
- We are not liable for losses arising from force majeure events including natural disasters, government actions, strikes, or pandemic-related disruptions
Indemnification
You agree to indemnify and hold harmless Asia Direct, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, misuse of our services, or violation of any applicable law or regulation.
All content, materials, and elements on the Asia Direct website are the exclusive intellectual property of Asia Direct Africa (Pty) Ltd or its licensors.
- The Asia Direct name, logo, brand identity, and trade marks are registered and protected
- All website content including text, images, graphics, and code is protected by copyright law
- You may not copy, reproduce, distribute, or create derivative works without our express written consent
- Limited personal, non-commercial use of website content is permitted for informational purposes only
- Any feedback, suggestions, or ideas you submit to us may be used by Asia Direct without compensation or obligation
Either party may terminate the service relationship subject to the following conditions:
Termination by Asia Direct
- Asia Direct reserves the right to suspend or terminate access to our services immediately without notice if you breach these Terms
- We may suspend services pending investigation of suspected fraud or illegal activity
- Termination for cause does not entitle you to a refund of fees paid for services already rendered
Termination by Client
- You may terminate use of our services at any time, subject to settlement of all outstanding fees
- Cancellation of orders already in transit or processing may incur cancellation fees as specified in your service agreement
- Written notice of termination should be sent to sa@asiadirect.africa
Upon termination, all provisions of these Terms that by their nature should survive termination shall continue to apply, including intellectual property rights, limitations of liability, and dispute resolution provisions.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
Dispute Process
- Step 1 — Direct Resolution: Parties will first attempt in good faith to resolve disputes through direct negotiation within 30 days
- Step 2 — Mediation: If unresolved, disputes will be referred to a mutually agreed mediator in Johannesburg
- Step 3 — Arbitration: If mediation fails, the dispute will be finally resolved by binding arbitration under the Arbitration Act of South Africa
